involved in these addresses, perhaps as much as president presidents like president clinton and others. but to clark's point, the biggest debate is within the republican party. the fact that they have two republicans in the response to the state of the union is a party that's divided. i think in the past election, we saw that the republican party is on the wrong side of history when it comes to climate change, guns, gay marriage, jobs, all these issues the president laid out in his inaugural address. we're going to hear how he's going to move those issues forward tuesday night in a way that is widely supported by the american people, and the republican party just needs to figure out whether they want to get on board with the rest of america or want to be behind the curve of history and be an afterthought over the next decade. >> paul, i've got to stop you right now. thank you very much. and also clark judge, we appreciate it. both men writing speeches for presidents past and present. tune in at 7:00 p.m. on tuesday for our live coverage of the state of the union speech. clinton

alone is not an economic plan. we learned in the 1990s when bill clinton was president nothing shrinks the deficit dpaster than a growing economy that creates good, middle class jobs. that should be our driving focus, making america a magnet for good jobs, ewinning how people with the skills required to fill those jobs. making sure their hard work leads to a decent living. those are the things we should be pushing ourselves to think about and work on every single day. that's what american people expect. that's what i'm going to work on every single day to help deliver. so i need everybody who's watches today to understand, we've got a few days, congress can do the right thing, we can avert just one more washington manufactured problem that slows our recovery and bring down our deficits in a balanced with, responsible way. that's my goal, that's what would do right by these first respond irs, that's what would do right by america's middle class. that's what i'm going to be working on and fighting for not just over the next few weeks, but over the next few years. thanks very much

, ashleigh, briefly there was an assault ban weapons that went into effect under clinton. it expired in 2004 and was not reinstated. furthermore not only was it not reinstated the federal government in 2005 under president bush said guess what, you cannot sue these manufacturers under theory of strict liability, defective product unreasonably dangerous thereby making them immune. there are some exceptions. my concern finally is this colorado ban that is proposed may violate federal law, and therefore may be problematic to implement. >> i will get to that in a minute. i want to be real clear, can you see a lot of guns in these pictures, some are pistols, some are assault style weapons. by the way we do not have a perfect definition of what an assault weapon is yet. we won't until we get our federal legislation in place. in the meantime, this set of proposals in colorado does not actually involve shotguns, bolt action rifles or handguns, just the assault style weapons. jeffrey toobin, weigh in on this. joey jackson mentioned federal law. this is state law. what happens? >> the courts h
